NIH Salary Cap UpdateSince 1990, Congress has legislatively mandated a limitation on direct salary for individuals under NIH grant and cooperative agreement awards The mandate appears in the Consolidated Appropriations Act, 2023 (Public Law 117-328), signed into law on December 29, 2022, which provides authority for NIH to incur obligations for Fiscal Year 2023. In December 2023, President Biden set new Executive Level Salary ranges by Executive Order, which set the Executive Level II salary at $221,900 effective January 1, 2024. Because the NIH salary cap is mandated by the NIH appropriation and the agency remains under a continuing resolution, UI applicants should continue to use the current NIH salary cap of $212,100 in applications for funding until salary limitation guidance for 2024 is announced by the NIH.
